Process & Resolution
Rancho Santiago Community College District is committed to responding promptly, fairly, and equitably to complaints of sex discrimination, sexual harassment, sexual misconduct, dating violence, domestic violence, stalking, retaliation, and pregnancy-related discrimination.
Our goal is to ensure a safe, respectful, and non-discriminatory educational and work environment for all members of the campus community.
When our office receives a report or complaint:
- Intake Is Scheduled
A member of our office will reach out to schedule an intake meeting with the reporting party (if known). During intake, we:- Listen to the concerns
- Explain rights and options
- Discuss available supportive measures
- Answering questions about the process
- Initial Review & Assessment
Our office reviews the information provided and:- Assesses safety considerations
- Determines whether the complaint falls under Title IX or another District policy
- Categorizes the complaint appropriately
- Identifies available resolution pathways
Supportive measures may be offered at any stage, regardless of whether a formal process is initiated.
Depending on the nature of the complaint and the wishes of the reporting party, the District may offer:
Informal Resolution
Informal resolution may be available when:
- Both parties voluntarily agree
- The matter is appropriate for alternative resolution
- The process complies with applicable law
Informal resolution may include:
- Facilitated discussions
- Agreement-based remedies
- Educational or restorative approaches
Participation in informal resolution is voluntary, and either party may request to proceed to a formal process instead.
Formal Investigation
If informal resolution is not appropriate or not selected, the matter may proceed with a formal investigation.
A formal process generally includes:
- Written notice of allegations
- Impartial review of information
- Interviews and evidence gathering
- Opportunity for both parties to respond
- A written determination
The District applies the preponderance of the evidence standard (more likely than not).
At the conclusion of a formal process:
- A written determination is issued.
- If a policy violation is found, appropriate corrective actions or discipline may be imposed.
- Both parties are informed of their appeal rights, if applicable.
Appeals may be submitted on limited grounds, as outlined in the written determination.
Both parties have the right to an advisor of their choice throughout the process.
An advisor may be:
- A friend
- A family member
- A faculty or staff member
- An attorney
The advisor may accompany the party to meetings and proceedings in accordance with District procedures.
If you have been named in a complaint:
- You will receive written notice of the allegations.
- You are presumed not responsible unless a determination is made.
- You will have an opportunity to respond and present information.
- Supportive measures may be available to you.
- Retaliation against any party or participant is strictly prohibited.
